Terms of Use for the “Mahjong” App (Android)

These Terms of Use govern the “Mahjong” app (the “App”) on Android phones and tablets. By downloading and using the App you agree to these terms. Your agreement is with me, not with Google.
2. The App and the Full Version
The App is a mahjong solitaire game. A large part of the levels is permanently free to play, with no ads and no time limits.
A one-time in-app purchase (the “Full Version”) additionally unlocks all levels, all tile designs, and the complete daily puzzle archive. It is a single purchase, not a subscription. There are no recurring charges.
- The purchase is processed entirely through Google Play. Google shows you the price and payment details before you buy.
- The Full Version is tied to your Google account and can be restored free of charge at any time on all your devices and after reinstalling, using “Restore Purchases” on the purchase screen.
- The Full Version supports the Google Play Family Library: members of your family group can use it without buying again.
- The purchase contract for the full version is not concluded with me but with Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland. Price, payment, refunds and any statutory right of withdrawal are therefore governed by Google's terms and must be asserted against Google. Refunds can be requested at support.google.com. Your statutory rights against Google remain unaffected.
3. License
You are granted a non-exclusive, non-transferable license to use the App on Android devices that you own or control, for private, non-commercial purposes, as permitted by the Google Play Terms of Service.
You may not copy, modify, decompile, reverse engineer, sell, rent, or otherwise make the App available to third parties outside the Play Family Library. All rights in the App, its content and its trademarks remain with me.
4. Optional Services
Play Games (leaderboards, achievements), saved-game sync, and challenge links are optional features. They require the corresponding Google services and an internet connection. The game itself works fully offline. I do not guarantee uninterrupted availability of these Google services.
5. Availability, Maintenance, and Support
I strive to keep the App free of defects and to update it regularly. I provide the updates necessary to maintain the conformity of the App, including security updates; there is no entitlement to any particular further features. I alone, not Google, am responsible for maintenance and support. Please direct support requests to joe@waldow.app or via https://waldow.app.
6. Liability
I am liable without limitation for intent and gross negligence and for injury to life, body or health, and to the extent of any guarantee I have given. In cases of simple negligence I am liable only for the breach of a material contractual obligation. Material contractual obligations are those obligations whose fulfilment makes achieving the purpose of the contract possible in the first place, on whose observance you may therefore rely, and whose breach endangers the achievement of the purpose of the contract. In such cases my liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Liability under mandatory product liability law remains unaffected. Your statutory rights in respect of defects in the app, and your rights against Google, are not restricted by this section.
7. Google's Role
Google distributes the App and processes payments, but is not a party to this agreement. Google owes you no warranty or support for the App and is not responsible for claims relating to it. Google's own terms apply to the distribution and payment relationship between you and Google.
8. Changes to These Terms
I may amend these terms with effect for the future, for example for new features or changes in the law. The current version is always available at https://waldow.app/terms-mahjong-android. Material changes will be announced in the App or in the update notes.
9. Final Provisions
German law applies. As a consumer, you additionally enjoy the protection of the mandatory provisions of the law of your place of habitual residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
