Terms of Use for the app Fastcinated and Fastcinated Pro

These Terms govern the use of the Fastcinated app and the features that can be unlocked within it (Fastcinated Pro) on iPhone, iPad and Apple Watch. They govern the relationship between you and me as the provider of the app.

2. App Store and purchases

These Terms govern use of the app between you and me. Downloads, payments and subscriptions are handled through the Apple App Store. The Apple terms applicable to your storefront and information shown before purchase govern the purchase process, billing, automatic renewal, cancellation, refunds and any withdrawal right. These Terms do not restrict statutory consumer rights.

Manage or cancel subscriptions in your Apple Account settings under “Subscriptions”. Deleting the app does not end a subscription.

3. Fastcinated Pro and virtual rewards

Fastcinated's core functions are free. Fastcinated Pro unlocks the additional functions identified in the offer and is available as an automatically renewing subscription or, when offered, a permanent one-time unlock (“Lifetime”). The term, price and any trial period are shown before purchase. A trial converts to a paid subscription on the stated terms unless cancelled in time.

RevenueCat supports technical verification and restoration of purchase entitlements; Apple handles payment. When Pro expires, access to additional features and designs unlocked exclusively through Pro ends. Elements earned independently or unlocked with virtual coins remain available. Subscription expiry does not delete existing personal entries.

Fasting Points, levels, coins, medals and Ringo badges are virtual motivational elements without monetary value. They are not transferable, redeemable for money or tradable outside the app. Fasting Points reflect the proportion of your personal goal completed and are capped at that goal; fasting longer gives no points bonus. A completed week with at least 50 percent weighted plan adherence earns one coin. Medals and selected badges are earned permanently. Pro opens the regular design catalogue; badges explicitly marked as earned remain tied to personal progress.

4. Licence

You receive the non-exclusive, non-transferable right to use Fastcinated on devices that you own or control, for private purposes, within the usage rules of the respective store. You may use Apple's Family Sharing where it is offered for the product in question.

You may not copy, modify, decompile, reverse engineer, sell or rent the app, circumvent protection mechanisms, or pass it on to third parties outside family sharing, insofar as this goes beyond the limits mandatorily permitted by law.

5. Adults and health

Fastcinated is intended for adults aged 18 and over. It documents and playfully accompanies a self-chosen routine. It does not provide medical advice, diagnosis or treatment and does not replace qualified medical care. It is not intended to diagnose, prevent, monitor or treat disease.

Fasting is not suitable for everyone. Consult a qualified healthcare professional about suitability, particularly if pregnant or breastfeeding, underweight, affected by an eating disorder, diabetes or another condition, or taking medication. The app's health check is neither an examination nor individual medical clearance to fast. If you experience symptoms, stop fasting and seek medical help where needed.

Time-based phases are general guidance, not measurements of your metabolism. Points, medals and animations do not establish a health benefit and are no reason to continue fasting beyond your wellbeing or chosen goal. No particular weight, energy or health changes are promised.

6. Availability and updates

For the duration of your subscription — or, for one-time purchases, for the period you can reasonably expect given the nature and purpose of the app — I provide the updates necessary to maintain the conformity of the app; this includes security updates. I inform you about available updates through the respective store.

If you do not install a provided update within a reasonable period, I am not liable for defects that result solely from the absence of that update; this applies only if I informed you about its availability and about the consequences of not installing it.

Beyond that, I may develop Fastcinated further. Individual features may be available differently depending on platform, operating system version and app version. There is no entitlement to uninterrupted availability.

7. Your data and backups

The app stores entries locally and, when iCloud is active, synchronizes them with your private CloudKit database. There is no account with me. Widgets and Apple Watch use a reduced current snapshot. Synchronization requires the relevant Apple services to be available; changes may appear with a delay. Keep your own exports or device backups where needed. Recovery after deletion, loss or damage cannot be assured in every case. Restoration of purchased entitlements through your Apple Account is separate. Statutory rights in the event of defects remain unaffected.

8. Permitted use

You may use Fastcinated only in accordance with applicable law. In particular, it is prohibited to misuse the app, to disrupt its operation, or to gain unauthorised access to paid features. In the event of serious breaches I may block access to paid features.

9. Intellectual property

All content and features of Fastcinated, in particular text, graphics, design elements, software and trademarks, are owned by me or by the respective rights holders. These Terms transfer no ownership rights to you, only the right of use described in section 4.

10. Liability

I am liable without limitation for damage caused intentionally or by gross negligence by me, my legal representatives or the people I engage to perform.

I am also liable without limitation for damage arising from injury to life, body or health, for damage for which I am answerable under the German Product Liability Act, and to the extent of any guarantee I have given.

In cases of simple negligence I am liable only for the breach of a material contractual obligation. Material contractual obligations are those obligations whose fulfilment makes achieving the purpose of the contract possible in the first place, on whose observance you may therefore rely, and whose breach endangers the achievement of the purpose of the contract. In such cases my liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

For loss of data I am liable, within the scope of the preceding paragraphs, only up to the amount that would have been incurred to restore the data had it been backed up properly and regularly. The first two paragraphs of this section remain unaffected.

Any further liability is excluded. The statutory rules on the burden of proof remain unaffected. Your statutory rights in respect of defects in the app, and your rights against the respective store operator, are not restricted by this section.

11. Changes to these Terms

I may change these Terms if and to the extent this is necessary to adapt them to a changed legal situation or case law, to changed requirements of the app store operators, or to technical and functional developments of Fastcinated, and the change is reasonable for you taking my interests into account.

The scope of the service I owe and the balance between service and payment are not changed by this. I will inform you about a planned change at least 30 days in advance in the app or by email and point out the changes to you. A change becomes effective towards you only if you expressly agree to it; if you do not agree, the previous version continues to apply to you.

Prices, billing, renewal and cancellation of your subscription are governed exclusively by the terms of the respective store operator (section 2) and cannot be changed through these Terms.

12. Position of Apple

These Terms are concluded between you and me, not with Apple. I alone am responsible for maintenance and support, not Apple; please direct support requests to joe@waldow.app. Apple has no warranty obligation with respect to the app and is not responsible for claims relating to the app, such as product liability, defects in title or consumer protection claims. In the event of third-party claims that the app infringes their intellectual property rights, I alone am responsible for investigation, defence and settlement.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a US government embargo and that you are not on any US government list of prohibited or restricted parties.

13. Final provisions

These Terms and the legal relationship between you and me are governed by the law of the Federal Republic of Germany. If you are a consumer and have your habitual residence in another state, this choice of law applies only insofar as it does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of that state.

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
